As a client of the company: IPM Industries, s.r.o., with its registered office at Sokolská 12, 960 01 Zvolen, Company ID: 36 629 561 (hereinafter referred to as the “data controller” or simply “controller”), we provide you, as the data subject, with the following information regarding the processing of your personal data and your rights as a data subject in accordance with Article 13 and following of the Regulation (EU) 2016/679 of the European Parliament and Council on the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter referred to as the “General Data Protection Regulation” or “GDPR”) as well as pursuant to Section 19 and following of Act No. 18/2018 Coll. on the protection of personal data and on the amendment of certain laws (hereinafter referred to as the “Personal Data Protection Act”):

B. Purposes for which we process your personal data

  1. Order fulfillment/contract performance/pre-contractual relationships: In order to process your order and to exercise rights and fulfill obligations arising from the concluded contract or pre-contractual relationships, it is necessary for us to know your name, surname, residence, date of birth, and contact details (phone number and email address). If you are a legal entity, it is necessary for us to know the name, surname, and position of the statutory representative, if the statutory representative is a natural person.
  • For this purpose, we collect your personal data, including: name, surname, date of birth, residence, phone number or delivery address, email address, and in the case of a statutory representative (natural person): name, surname, position, company name, phone number, and email address. Any other unnecessary personal data provided voluntarily by the data subject will not be further processed and will be discarded.
  • We obtain your personal data through your request (email, written) to conclude a contract; delivered order (email, written); completed and sent form available on the controller’s website.
  • The above personal data is considered essential for the purpose of processing and delivering the order (i.e., for contract performance or pre-contractual relationships).
  • If you do not agree to provide these personal data, we will not be able to fulfill your request to conclude the contract or process your order.
  • We process your personal data only for the necessary period, which is until your order is processed or during the duration of the contractual relationship, or for the warranty period.
  • If you delay payment for an invoice for the delivered goods or services, we are entitled to use the personal data you provided for the purpose of recovering the debt through extrajudicial measures, in court, or with other relevant authorities.
  1. Direct marketing – newsletters/sending information about news, expansion of activities
  • For the purpose of direct marketing – to inform clients about news, promotions, business expansion, and activities, we process your personal data in the following scope: name, surname, delivery address, email address, phone number.
  • For this purpose, we collect your personal data in the following scope: name, surname, delivery address, email address, phone number, and in the case of a statutory representative (natural person): name, surname, position, company name, phone number, and email address. Any other unnecessary personal data voluntarily provided by the data subject will not be further processed and will be discarded.
  • We obtain your personal data through your request (email, written) to conclude a contract; delivered order (email, written); completed and sent form available on the controller’s website.
  • We process the above personal data based on our legitimate interest, i.e., we do not need your written consent to process your personal data for direct marketing purposes under GDPR.
  • We process personal data for direct marketing purposes for a maximum of 10 years.
  • Although we do not need your consent to process your personal data for direct marketing purposes, you have the right to object to the processing of your personal data for direct marketing purposes, i.e., to request that we no longer contact you about news, promotions, expansion of activities, and that we cease processing your personal data for direct marketing purposes.

C. Recipients of the personal data of the data subject:

Your personal data, which we process for the purpose of order fulfillment, may be provided to external accounting firms or, for example, law firms, lawyers, or other similar entities that process personal data based on the law (e.g., Act No. 586/2003 Coll. on Advocacy for the purpose of recovering debts and other claims arising from contractual obligations). Your personal data processed for the purpose of direct marketing may be provided to external marketing firms that will carry out direct marketing as a processor on behalf of our company.

D. Transfer of personal data to a third country

We do not transfer and do not intend to transfer your personal data to a third country or international organization.

E. Retention period of personal data

We retain personal data for as long as necessary to exercise the rights and obligations of the data subject arising from the concluded contract/order or for as long as processing of the personal data is necessary for the purposes for which they were provided.

F. Automated individual decision-making, including profiling

No decisions will be made for our clients based solely on automated processing, including profiling, which has legal effects concerning them or similarly significantly affects them.

YOUR RIGHTS REGARDING PERSONAL DATA PROCESSING

  1. Processing of personal data for the purpose of Direct marketing: You have the right to object at any time. In other words, you have the right to ask us not to contact you for direct marketing purposes. If you object to the processing of personal data for direct marketing purposes, we will no longer contact you for marketing purposes and will no longer process your personal data for this purpose, i.e., we will not send you information about news, promotions, and activities.
  2. You have the right to request information at any time on whether and to what extent we process your personal data. Upon your request, we will provide confirmation and information regarding the processing of your personal data, in the manner you request (by phone, email, mail, or in person).
  3. You have the right to ensure that the data we process about you is correct, current, and complete. For this purpose, you have the right to request immediate correction, updating, or completion of incomplete personal data.
  4. You have the right to object to the inaccuracy or unlawfulness of the processing of your personal data.
  5. You have the right to request that we delete your personal data if: they are no longer needed for the purposes for which they were processed; they are processed unlawfully; deletion is required by law; they were obtained from a child; they are processed beyond the purpose; or if you have withdrawn your consent to their processing.
  6. You have the right not to be subject to a decision based solely on automated processing of your personal data, including profiling, which significantly affects you.
  7. As a data subject, you have the right to request the restriction of the processing of your personal data if you contest their accuracy, for a period that allows us to verify their accuracy, or if their processing is unlawful.
  8. You have the right to request the provision of your personal data in electronic form or in another commonly used, machine-readable format that allows the transfer of your personal data to another controller. If technically feasible, the transfer of your data can be carried out directly from one controller to another. The transfer of your personal data is possible only if we process your personal data based on your consent or a contractual relationship.
  9. As a data subject, you have the right to submit a proposal to initiate proceedings regarding the protection of personal data, aiming to determine whether a violation of rights has occurred in the processing of your personal data or whether the Personal Data Protection Act has been violated. The details of the proposal and the proceedings are regulated by Section 100 of Act No. 18/2018 Coll. on Personal Data Protection. The supervisory authority is: Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava 27.
